General Conditions of Contract

These general conditions of contract expressly regulate the commercial relations between MARGARITA MONTANÉ, S.L. (hereinafter MONTANÉ) and the users who purchase the products offered through this website.

Users are informed that MONTANÉ reserves the right to modify at all times these general conditions of contract, at any point provided, respecting in any case the general conditions in force at the time of making the contract or purchase made by the user.

These conditions have been prepared in accordance with the provisions of Law 34/2002, on services of the information society and electronic commerce, Law 7/1998 on General Conditions of Contract, Royal Legislative Decree 1/2007 approving the revised text of the General Law for the Defence of Consumers and Users as last amended in Law 3/2014 of 27 March, Law 7/1996 on Retail Trade Regulation and any legal provisions that apply.

The user, with the acceptance of the terms and conditions declares to know and accept the procedures set out here as necessary to proceed with the purchase.

Pre-purchase information

All users will be able to view within the website, classified by categories and subcategories, all products offered for purchase. By clicking on each of them, the user will be able to access a complete sheet of the product where a small description, availability and price will be indicated. Users are informed that all data provided in the product description are made based on the information provided by their suppliers.

All prices are shown in euros and include the applicable VAT and/or any other tax that may apply, depending on the country from which the purchase is made. These prices will be in force at all times, with the exception of possible manifest typographical errors. Transportation cost, only when is  needed, is not included in the prices shown for the products, and its cost is broken down later at the time of completion of the purchase.

Purchase system

The procedures for purchasing products will be those shown on screen at any time and described in these General Conditions. Users will be able to register as MONTANÉ members during the product purchase process to enjoy promotional benefits. In the same way, the user is provided with a method of purchase without the need to register with MONTANÉ, where an email address will be requested.

To proceed with the purchase of the products, the user must click “Add to Cart” on each product. As the user selects what they want, they can preview in the upper right of the website the “Basket” with the outstanding products, which will be updated as products are added, as well as transport costs. If the user wants to see more detail their order, they can click on the “Basket” and they will be directed to another screen where they can see a summary of the selected products. From there you can choose to continue shopping or confirm your order.

In the Summary screen of the “Basket”, the user can make use of a discount voucher that MONTANÉ has given him derived from some promotion, sweepstakes or other circumstance. To validate it you must click on “Enter your coupon” and you will see the discount in the price breakdown, provided that it is still valid according to your particular conditions.

When the user has completed their shopping list, they will need to click on the “Successful” button at the bottom of the breakdown of their purchase. From this moment on you must complete the information as requested and select, where appropriate, the delivery and billing address, shipping method, as well as indicate the payment method you want to use.

Payment System

Payment can be made via PayPal or Stripe. The user may choose the payment method at the end of the purchase, and both payments will be subject to the following conditions:

Payment via a payment gateway managed by Paypal or Stripe with a secure server certified according to SSL protocol. The bank details entered are encrypted and transmitted securely, and then verified to prevent possible fraud and abuse. MONTANÉ does not have the bank details or the credit or debit card used by the user to make the purchase.

Where the amount of the purchase has been charged fraudulently or unduly, the buyer shall be entitled to demand the immediate cancellation of the charge. However, if the purchase was actually made by the card-holder buyer and the return requirement was not the result of the exercise of the right of withdrawal or resolution, the cardholder shall be obliged against the entrepreneur to recover the damages caused as a result of such cancellation .

Selecting the payment method and having finished the order MONTANÉ will always send an email to the user confirming the order.

Shipping Orders

Shipping costs will vary depending on the destination and shipping mode selected and will be displayed at all times on screen. Shipping costs will be borne by the buyer, except in cases where otherwise stipulated on screen by MONTANÉ or by current promotions.

MONTANÉ emphasizes the responsibility of the user to enter a complete and correct delivery address. At the time of departure of the distribution order the customer will be informed of this fact and the carrier will activate the tracking functions to ensure delivery.

  • Within Spain
> Courier: Delivery within 24 - 48 working hours after the order leaves our warehouse.

  • International Shipping
> Courier: We send the order to the shipping address you provide. Delivery in 3 - 5 working days on average since the order leaves our warehouse, although it may be delayed depending on the country of destination of the order.

Delivery times may be altered by extraordinary incidents in the carrier, difficulties in the delivery of the goods or causes of force majeure.

Exceptions to delivery times:

During the special offers on the MONTANÉ website, the delivery time may be longer than usual.

MONTANÉ holiday periods will be notified on the website and during the purchase process.

MONTANÉ will not assume any responsibility for delay in delivery of orders when this delay is the sole fault of the buyer or the authorized person.

The customer assumes the risks of deterioration, impairment, damage and loss of the products of the order from the moment of delivery of the same in accordance with the procedure regulated in these Terms and Conditions. The customer will be responsible for the storage and preservation of the products under the conditions that, if applicable, are established on their labelling.

Return Policy

By virtue of the provisions of article 102 of the Consolidated Text of the General Law for the Defense of Consumers and Users, the client will have a period of up to fourteen calendar days from receipt of the product to exercise their right of withdrawal, without indicate any reason (MONTANÉ extends this period to 30 calendar days to extend the client's flexibility).

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement to the address Paratge Can Viader, S / N, El Roqué, in the town of Gualba (Zip Code 08474 - Barcelona); or through email info@montaneshoes.com. To do this, you can use the withdrawal form model included in Annex 1 of these general conditions. After this communication, MONTANÉ will contact the buyer to give him the appropriate instructions to make the shipment.

In case of withdrawal on your part, all payments received from you will be returned to the client.

Returns in MONTANE are free in Spain (Peninsula), Portugal, France and Germany (carrier return service point). In the rest of the countries or in any other case, the shipping costs for the execution of the return will be borne by the user.

Returned products must be in normal condition (with its original and unused packaging). It will be necessary to attach a copy of the invoice. Before returning the product, the user must ensure that it is properly protected and sealed so that it does not suffer any damage during transport.

If the reason for the return is that the product is defective or does not correspond to what was ordered, MONTANÉ will bear the costs of the return and the new shipment.

The refund of the amount will be made once the returned order arrives at our offices and with the same form of payment that has been used.

The exercise of the right of withdrawal will extinguish the obligations of the parties to execute the contract.

Product Warranty

Where the Product (s) purchased show a lack of conformity because it does not correspond to the characteristics offered, have defects that prevent their normal use according to their nature, or do not offer the services described for it, the Customer shall have the right to clean up the goods acquired in a period of two years from the purchase, as stipulated in Article 123.1 of the Consolidated Text of the General Law for the Protection of Consumers and Users and under the conditions and with the means of proof regulated in the same legal text, without prejudice to MONTANÉ 's powers toverify the veracity of the defects, their origin and the time of their appearance.

In any case, the Customer must inform MONTANÉ of the lack of conformity within two months of becoming aware of it. To do this, it will be necessary to report on the nature of the problem, the timing and conditions of its occurrence.

Similarly, inform that the client has the right to sanitation the property following the rules of article 118 et seq. of the Consolidated Text of the General Law for the Protection of Consumers and Users. In any case, the legislation on guarantee of sale of consumer goods shall apply. If the product is defective, MONTANÉ will be responsible whenever possible to replace the product, without any expense to the Customer. If for reasons of availability it is not possible to make the replacement of the product, the full refund of the purchase will be made.

Applicable legislation.

The use of our website and the contracts for the purchase of products through this website will be governed by Spanish law.

Any dispute arising out of or relating to the use of the website or to such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.

If you are contracting as a consumer, nothing in this clause will affect your rights under applicable law.

In the case of a sale made by a company acting in the framework of its business or commercial activity, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Granollers (Spain).

Information on Online Dispute Resolve/Consumer Arbitration

Pursuant to Regulation (EU) 524/2013, which is applicable throughout the European Union, the European Commission provides an online dispute resolution platform which MONTANÉ makes available to users of this website at the following link: http://ec.europa.eu/consumers/odr

By means of this link, users of the Website will be able to access the European Platform for Online Dispute Resolution (ODR). In the event that the user has had a problem with a purchase or the provision of an online service, he may use this means to file any complaint in connection with such sale or provision of services, as well as opt for the out-of-court settlement of the dispute.
